N.G.T International (2004) Ltd. permits you, through its websites, to use an Internet Operating System (IOS) for editing personal and commercial newspapers and websites, with which you can produce and manage a newspaper or a website in any field or subject matter you wish, subject only to these By-Laws and to the Terms of Service.
N.G.T By-Laws Terms of Service
These By-Laws use the singular masculine form for convenience purposes only, and all of the contents hereof are equally directed at men and women. Please read the detailed terms carefully before making any use of the technology available on the site, since by taking part in the site you are expressing your complete consent to the Site’s Terms of Service.
N.G.T International (2004) Ltd. operates sites (hereinafter: the “Site”) that offer Internet surfers an IOS for setting up and managing content (hereinafter: the “Software”). Using the Software or a site offered in this Site is subject to and contingent upon the newspaper’s editor or Webmaster’s consent to the contents hereof.
“Webmaster” – A person, including an incorporated entity or a group of people, who uses the Software out of his domain on N.G.T’s server or out of a subsidiary site of N.G.T’s, manages a site using the Software in any manner whatsoever, including editing a newspaper, editing a personal site, information transferred through his domain, writing articles, uploading files, organizing forums, watching, reading or writing notices, or any other use enabled in the system.
“End User” – A person, including an incorporated entity or a group of people, who enters the Webmaster’s domain, and uses it in any manner whatsoever, including watching, reading or writing notices, writing in forums, or any other use enabled in the system.
Use of the Site shall be done solely in accordance with the Site’s Terms of Service and instructions for use. Without detracting from the generality of the foregoing, each user of the Site undertakes that other than the ordinary use of the Site, he shall not break into the Site and/or change and/or detract and/or add to and/or in any way harm the contents and/or design of the Site and/or the software servicing it and/or any other material contained therein.
All rights reserved. Other than the possibility of downloading the Software, offered to every use, nothing contained in this Site may be copied, translated, transmitted through any medium, stored in a databank, or published or distributed through any medium.
All intellectual property rights, including copyrights, in the concept embodied in the N.G.T Site, as well as in the technical specifications, including the Site’s design and including: software, application, graphic file, computer code, text and picture – are solely owned by N.G.T.
The aforesaid technical information may not be copied, distributed, publicly displayed or otherwise used, without obtaining N.G.T’s prior written consent, including full and/or partial copying; use of trademarks and/or logo; translation; re-editing, etc., excluding for personal use in accordance with the site’s instructions.
N.G.T grants the surfers in its Site the permission to use a management Software that provides the technical ability to manage contents of all types on all subjects. Having agreed to and undertaken to abide by the Terms of Use, the Webmaster operates the Software in his own private domain and/or in a subsidiary site of N.G.T’s, an action which disassociates the Webmaster from N.G.T.
It is hereby emphasized and clarified that N.G.T is not responsible for the contents of any information, whether published by the Webmaster himself in his own domain or by advertising entities in the Webmaster’s site, whether such information is presented as text, pictures, audio or multimedia.
N.G.T shall not be responsible for any information published through the information management software and/or the newspaper and/or the site in the Webmaster’s domain and/or in the Site.
N.G.T does not write, check, ensure or edit the contents or correctness of the information in the newspaper editor or Webmaster’s domain. The sole responsibility for the contents of the information and the commercial information is the Webmaster’s alone.
N.G.T shall not be responsible for any direct or indirect, financial or other damage caused to third parties as a result of using or relying on the information published in the Webmaster’s domain.
N.G.T shall not be responsible for any information published through the newspaper management software distributed in the Site.
N.G.T is not and shall not be responsible for any messages, news and publications of any sort or type, the nature and contents of all or part of the discussions in the forums and the newspaper editorials, and all responsibility in this matter shall be borne solely by the Webmaster.
N.G.T shall not be responsible for any errors, malfunctions, shutdowns or any other inconvenience caused during or as a result of the use of the Site.
The Webmaster agrees that N.G.T shall be granted
exclusivity in all matters pertaining to advertising in the domain he will set
up. Advertising in the Webmaster’s domain will include commercial information
advertised by various advertisers. Such information may be displayed as banners
and/or promotional articles and/or any other use N.G.T shall see fit, e.g.:
pop-ups, audio advertising, video, etc.
At the same time, it is hereby clarified and emphasized, both as regards the Webmasters and as regards all End Users, that N.G.T shall not be responsible for the contents of the commercial information, the advertisements and the notices published on the Site. N.G.T does not write, check, ensure or edit the contents or correctness of such information. The sole responsibility for the contents of the advertisements and the commercial information is borne by the advertisers. Publishing commercial information, advertisements or notices does not constitute a recommendation or encouragement to purchase the products or services offered for sale therein.
Any transaction executed following an advertisement or information published in the Webmaster’s domain shall be agreed upon between the surfer on the domain, the Webmaster who is interested in the advertised product, and the relevant advertiser. N.G.T is not party to any such transaction, and shall not be responsible for software or goods offered in advertisements and notices published in or purchased through the Webmaster’s domain, including as regards their delivery, their terms of payment or any other component of such transactions. N.G.T shall also not be responsible for damage caused to whomsoever shall engage in such a transaction.
Beside some of the advertisements on the Webmaster’s domain there may appear links to various pricelists. Such pricelists or information are not to be deemed to be a recommendation on N.G.T’s part for making any purchase, and in any event, the pricelists or information constitute no alternative for the purchaser’s examination. N.G.T is in no way responsible for the correctness of the information contained in the pricelists.
It is hereby emphasized and clarified that the Site operators shall not be liable to any third party for any action the Webmaster or the surfers may take in the information management software provided by N.G.T.
Forbidden Use of the N.G.T Software:
In addition, and without the following being construed as the assumption of any liability, N.G.T sees fit to expressly note to the Webmaster that it is absolutely forbidden to place content in the system, which is illegal and/or is illegal to place, and/or which is intended for illegal purposes and/or which harm the operation of the system. Among others, and without detracting from the generality of the foregoing, none of the contents specified below are to be placed on the system:
· Any content that may harm the public sentiment, including any content that is of a vexatious, insulting, defamatory, hostile or injurious nature, that may harm the sentiments and beliefs of the general public – both as regards individuals and the general public and/or any specific group of people.
· Any content that constitutes libel against a person or that harms his privacy.
· Any content that may constitute grounds for a civil lawsuit or a criminal complaint or constitutes any other transgression of the law, including all illegal content, or content encouraging, supporting, abetting or guiding an action that constitutes a criminal offense and/or a tortious act both under the laws of the State of Israel and under any law applicable in the relevant countries.
· Any content that harms and/or may harm the goodwill and good name of N.G.T and/or any third party.
· Any content that may mislead a consumer, as such action is defined in the Consumer Protection Law, 5741-1981, or the Webmaster and/or third party’s customers.
N.G.T applies systems and procedures on the Site for information security. While these systems and procedures narrow down the risks of unauthorized entry into N.G.T’s computers, they do not afford absolute security. Therefore, N.G.T does not undertake that its servers shall be absolutely immune to unauthorized access to the information stored therein.
The Webmasters must ensure periodic backups, and N.G.T shall have no liability or responsibility for the failure to carry out backups.
The use of the Sites of N.G.T shall be subject solely to the laws of the State of Israel. The exclusive jurisdiction over any matter arising from these By Laws or from the Site is granted to the competent courts of the districts of Tel Aviv and Jerusalem.
The purchase of upgraded hosting is prohibited under the age of 18.
The billing is done once a month, on the date of the initial purchase.
In case the purchase is done on the 29th, 30th or 31st - the consecutive billing will be done on the 28th of the next month.
The purchase of multiple upgrades is possible. The billing will be done seperately.
The purchase may be canceled at any moment. The cancelation will become affective on the next billing date.
You will not be billed for cancelation. You will not receive refund for cancelations.
